EPCRA Gas Station Update (February 11, 1999)

On February 11, 1999, EPA finalized amendments to hazardous chemical reporting thresholds for gasoline and diesel fuel at retail gas stations pursuant to the Emergency Planning and Community Right-to-Know Act of 1986 (EPCRA). Specifically, EPA is raising the thresholds that trigger Material Safety Data Sheet (MSDS) reporting and annual chemical inventory reporting under Sections 311 and 312 of EPCRA. The new thresholds are 75,000 gallons for gasoline and 100,000 gallons for diesel fuel stored entirely underground at retail gas stations that comply with requirements for underground storage tanks (USTs)(40 CFR Part 280). Since the effective date of the rule is February 11, 1999, this final rule provides relief to all qualifying gas stations from annual inventory reports due on March 1, 1999.

RMP AMENDMENTS ARE FINAL (DECEMBER 29, 1998)

The amendments to the RMP (Risk Management Plans) rule, proposed on April 17,
1998 were signed by Administrator Browner on December 29th. An EPA fact sheet explaining the amendments is available on EHSO's RMP page. The notice was published in the Federal Register on January 6, 1999 and is available as a PDF or ASCII file here.

Here is the summary: "This action modifies the chemical accident prevention rule
codified in 40 CFR Part 68. The chemical accident prevention rule requires owners and operators of stationary sources subject to the rule to submit a risk management plan (RMP) by June 21, 1999, to a central location specified by EPA. In this action, EPA is amending the rule to: add four mandatory and five optional RMP data elements, establish
specific procedures for protecting confidential business information when submitting RMPs, adopt the government's use of a new industry classification system, and make technical corrections and clarifications to Part 68. However, as stated in the proposed rule for these amendments, this action does not address issues concerning public access to offsite consequence analysis data in the RMP. DATES: The rule is effective February 5, 1999.

PCB TRANSFORMER NOTIFICATIONS DEADLINE PASSED
(DECEMBER 28, 1998)

If you have PCB-containing transformers, regulated under TSCA (40 CFR Part 761) then you had to submit a notification form to the EPA by December 28, 1998 - for details, see 40 CFR 761.30(a)(1)(vi)(A). which was changed in the PCB Megarule (remember - these changes have not yet made it into any printer or online version of the CFR yet!)

UNDERGROUND STORAGE TANK DEADLINE: DECEMBER 22, 1998

FORECAST FOR EPA AND OSHA IN FISCAL YEAR 1999

Congressional representatives have little time before they return to their
districts for the November elections. None of the revisions to the environmentalor safety laws proposed this year will see any action. However, bills that will extend EPA's and OSHA's funding may have significant impacts on these agencies.

H.R. 4194, which was approved by a House and Senate conference contains language designed to ensure that the EPA does not attempt to implement the Kyoto Treaty through back-door means. The conference report states that none of the funds should be used "to implement actions called for solely" under the treaty. The treaty commits industrialized nations to reductions in emissions of "greenhouse gases," such as carbon dioxide. The rider to the budget bill limits EPA's ability to commit U.S. companies to emission reductions.

The bill that funds OSHA for fiscal year 1999 (H.R. 4274) contains language that would require the National Academy of Sciences to conduct a study into the causes and solutions of repetitive motion disorders. The House bill also freezes OSHA's funding at last year's level ($336.7 million), cuts OSHA enforcement budget by $5.5 million, and shifts that money to OSHA's compliance assistance program. The Senate committee version of this bill increases OSHA's funding $12.3 million over last year's level (total funding set at $349 million) and increases funding for OSHA's enforcement program by $4.2 million.

FINAL MULTISECTOR STORMWATER PERMIT ISSUED

EPA issued the new multisector permit (MSGP) on September 30, 1998 (63 FR 52429).Facilities covered under the old baseline industrial general permit will be required to seek coverage under the new permit or obtain individual permits by December 29. EPA has modified the MSGP to authorize storm water discharges from previously excluded facilities now covered by the MSGP after expiration of the Baseline Industrial General Permit. EPA also made the following changes to the MSGP as published on September 29, 1995 (60 FR 50804):

Authorization of mine dewatering discharges from construction sand and gravel, industrial sand, and crushed stone mines in EPA Regions I, II and X; inclusion in Sector A of the MSGP of the effluent limitation guideline in 40 CFR Part 429, Subpart I for discharges resulting from spray down of lumber and wood products in storage yards (wet decking); clarification that Sectors X and AA authorize discharges from all facilities in major SIC groups 27 and 34 respectively; addition of new Sector AD to the MSGP to authorize discharges from Phase I facilities which may not fall into one of the original sectors of the permit, and selected Phase II discharges which are designated for permitting in accordance with 40 CFR 122.26(g)(1)(i); modification of inspection requirements in Sector I for inactive oil and gas extraction facilities which are remotely located and unstaffed; addition of new Addendum I to provide
guidance and information to assist applicants with determining permit eligibility concerning protection of historic properties; and update of the county/species list of endangered and threatened species found in Addendum H, and provide a listing of additional sources to reference for future updates to the list.

VICE PRESIDENT GORE ANNOUNCES PROGRAM TO CLOSE GAP IN PUBLIC'S RIGHT-TO-KNOW ABOUT POTENTIALLY HARMFUL CHEMICALS

BOSTON, MA-October 9, 1998 - Vice President Gore announced today that, "under a new program, companies will voluntarily test the human health and environmental effects of the chemicals they manufacture and make the information availible to the public.

"This major new effort will close a gap in the public's right-to-
know about potential harmful chemicals released into our air, our
land, and our water," the Vice President said of the agreement among
the Environmental Protection Agency (EPA), the Chemical Manufacturers' Association, and the Environmental Defense Fund. "This effort honors the public's right-to-know about possible risks to their families while prompting companies to make more informed and sensible decisions about chemical use."

The program builds on the Vice President's Earth Day challenge to
the chemical industry to give Americans basic information about the
potential health effects of chemicals used widely in their
communities. Companies will voluntarily conduct test on the human
health and environmental effects of the chemicals they manufacture.
The American Petroleum Institute, whose members produce many of these chemicals to be tested, endorsed the agreement.

Test results will be immediately available, and testing of these
high-volume chemicals should be completed by the year 2004. To ensure that Americans have adequate information on health effects, the EPA will use its regulatory power to require more testing if companies do not voluntarily provide the needed information in a timely manner.

Today's announcement builds on Administration efforts to give
communities access to more information about chemicals released into their air and water. EPA has doubled the number of chemicals subject to reporting under the Toxics Release Inventory, which requires
industrial facilities to disclose how much chemical pollution they
release to the environment. Last year, the President [reported] a 30
percent increase in the number of facilities required to report data.
Of the 2,800 most widely-used chemicals, complete data on health
effects is available for only 7 percent.

The public will be able to follow the progress in gaining
information about these chemicals on the Internet. The web address
